To offer legal advice for business units and management teams in Mainland China and worldwide. This position will provide both strategic and tactical guidance, consultation and support to stakeholders on a comprehensive range of legal and associated issues, including advice and guidance on hospitality business development and operational matters.
Act as a trusted business partner to provide advice and counsel to senior management and other key stakeholders on a broad spectrum of legal topics and matters, of current and developing legal issues and trends in relevant area of expertise
Provide legal and strategic support across our business units and management teams in Mainland China and worldwide, with particular focus on hotel management / franchise arrangements, property sales and leasing matters and data privacy.
Draft, review and negotiate general commercial contracts, including letter of intents, hotel management and franchise agreements, joint venture agreements, tenancy and general conveyancing documentations, employment agreements and other commercial agreements and arrangements.
Provide legal support on matters related to day-to-day operations, including keeping record of legal documents and proceedings for the company, facilitate filings of licensing forms and other statutory requirements, advising on and providing guidance on new legal developments impacting the business.
Advise, manage and guide strategy of contentious matters, including advising on and managing effective litigation management, discovery process and settlement strategies; and dealing with regulators and investigators including state and regional administration for market regulation.
Guide management and business operations on Mainland China and international regulatory and compliance issues, including advising on and ensuring compliance of hotels policies and practices with applicable laws and regulations (e.g. privacy and record keeping).
Work with local leaders to develop appropriate risk mitigation strategies and ensure proactive legal advice is effectively and efficiently delivered in order to mitigate present and potential future risk and exposure.
Provide training to internal stakeholders on legal developments and suggested best practices.
Select and retains outside counsel, as required and to work effectively with outside counsel.
Report effectively to Head of Legal.
Academic and Working Qualifications
LLB or Juris Doctor (JD) from an accredited law school. Qualified as a Mainland China lawyer
5 years or more of legal experience in leading international law firms or reputable corporations
Demonstrates ability to guide, manage and coordinate the work of different business units, including experience in developing and implement legal strategies and solutions
Ability to function independently and effectively
Ability to multi-task and successfully execute multiple projects, priorities and schedules simultaneously with high level of personal and professional integrity and trustworthiness with strong work ethics
Excellent interpersonal, analytical/problem solving and communication skills
Ability to travel domestically as needed, as much as 50% of time
Proficiency in English and Mandarin
